DATA PROTECTION NOTICE

  1. DEFINITIONS AND PURPOSES OF PROCESSING

In order to process requests addressed to it, Mirabaud VantageBridge Partners (hereinafter also referred to as “MVB” or “We”), acting as data controller, processes personal data relating to you.

“Personal data” means any information relating to an identified or identifiable natural person within the meaning of applicable data protection legislation.

This data protection notice (hereinafter the “Notice”) describes how we process personal data in the context of the handling of requests submitted to us, in particular via contact forms available on our website. 

“Service” includes in particular the management and follow-up of your requests (e.g., via a contact form). 

“Visitor” or “You” means a natural person who browses the MVB website.

  1. WHICH PERSONAL DATA DO WE PROCESS ABOUT YOU?

In the above context, we may collect and process the following categories of personal data:

  • identification data (e.g., first name, last name); 
  • contact details (e.g., email address); 
  • data relating to your interactions with our communication and collaboration tools; 
  • data relating to your habits and preferences; 
  • information transmitted via cookies (cookies and similar technologies on websites and in emails). 

We may also process any other information that you choose to communicate to us voluntarily, in particular in free-text fields.

The provision of sensitive data is not required for the Service. We ask you not to provide such data. However, if you do provide sensitive data, whether voluntarily or inadvertently, such data may be processed in accordance with this Notice and applicable legislation.

  1. WITH WHOM DO WE SHARE YOUR PERSONAL DATA?

By completing our online contact form in order to use our Service, you consent to the collection, transfer, and processing of your personal data abroad by MVB.

As part of the provision of the Service, Mirabaud & Cie Ltd (or any entity of the Mirabaud Group) (hereinafter “Mirabaud”) or VantageBridge International Holdings Ltd (hereinafter “VantageBridge”) may contact you after you have submitted a request through the contact us form or via email to info@mvbpartners.com. 

Furthermore, we may use the services of third-party service providers which perform services on our behalf, such as website hosting, IT infrastructure, communication systems, cloud storage, security monitoring, analytics and other website or administrative support services. These providers may, in turn, subcontract certain operations to their own subprocessors, where applicable.

In case of marketing communications, you may unsubscribe from them at any time by following the instructions included at the bottom of the emails received.

  1. ARE PERSONAL DATA TRANSFERRED OUTSIDE OUR JURISDICTION?

Your personal data may be processed in Switzerland, the United Arab Emirates and in other jurisdictions where Mirabaud Group entities, VantageBridge entities or our service providers are located. In the case of international transfers, your data may be transferred to countries recognized by the competent authority as providing an adequate level of data protection.

For transfers to countries not recognized as providing an adequate level of protection, we rely on:

  • your consent when completing our online contact form; and/or 
  • the implementation of appropriate contractual, technical, and/or organizational safeguards to ensure the protection of your personal data (such as standard contractual clauses or binding corporate rules approved by competent authorities, access control processes, privilege management, and data segregation). 

Despite all precautions and safeguard measures implemented, the following risks may arise due to the transfer of your personal data:

  1. possible access to your personal data by local authorities; 
  2. possible extraterritorial access by foreign authorities (e.g., under the US CLOUD Act); 
  3. lack of sufficient enforcement or sanctions in case of breach of contract between MVB and its service providers or of applicable foreign law; and 
  4. inability for MVB, Mirabaud, VantageBridge or the Visitor to defend themselves effectively through legal means.

Our website uses one essential functional cookie to ensure its proper functioning and the correct loading of pages. This cookie, named _lscache_vary, is placed by our hosting and caching system (LiteSpeed Cache) and enables the website to determine which version of a page should be displayed to visitors.

Type: strictly necessary / functional
Purpose: identifies cached content variants, for example for guest or logged-in users, in order to improve the speed and reliability of the website
Default lifetime: approximately 2 days

This cookie does not collect personal data, does not track users’ behaviour and does not share any information with third parties. You may configure your browser to block this cookie or to alert you about it. However, certain features of the website may not function properly without it.

If analytics tracking is enabled, our website may also use Google Analytics cookies for statistical purposes, only after the visitor has given consent.

Purpose: measures visits to and use of the website, including information relating to sessions and repeat visits, in order to help us improve the interest and ergonomics of the website

Depending on the applicable data protection laws, you have the following rights:

  • right of access: you can obtain information relating to the processing of your personal data and ask to receive a copy of personal data; 
  • right to rectify: where you consider that your personal data are inaccurate or incomplete, you can request that such personal data be modified accordingly; 
  • right to erasure: you can request the deletion of your personal data, to the extent permitted by law; 
  • right to restrict: you can request that the processing of your personal data be restricted; 
  • right to object: you can object to the processing of your personal data, on grounds relating to your particular situation; 
  • right to withdraw your consent: where you have given your consent for the processing of your personal data, you have the right to withdraw your consent at any time; 
  • right to data portability: where legally applicable, you have the right to have the personal data you have provided to us be returned to you or, where technically feasible, transferred to a third party.

Even if you object to the processing of personal data, we are nevertheless permitted to continue that processing if it is (i) legally mandatory, (ii) necessary for the performance of a contract to which you are a party, (iii) necessary for the performance of a task carried out in the public interest, or (iv) necessary for the purposes of the legitimate interests we pursue, including the establishment, exercise or defence of legal claims. However, we will not use your personal data for direct marketing purposes if you ask us not to do so.
